The Nigerian Baptist Convention (NBC) on Tuesday confirmed the agreement with the Baale Osupa Chieftaincy family of Ogbomoso over land dispute involving the Nigerian Baptist Theological Seminary NBTS and the Bowen University Teaching Hospital BUTH, saying however that the matter was not an-out-of-court settlement but that judgement was delivered.
This is contrary to an earlier report that the matter was settled out of court.
This is as the Soun of Ogbomosoland His Imperial Majesty Oba Ghandi Afolabi Olaoye Orumogege III was commended for what was described as his excellent mediation role.
“The case was not withdrawn, judgement was delivered,” Barrister Kayode Bankole, legal counsel of the NBC told ogbomosoinsightonline.com during a chat after the court sitting.

“Yes, judgement was actually delivered, it was not a case of out-of-court settlement. Judgement was delivered based on the consent of the parties. And the Kabiyesi should be praised for intervening urging us to concede some things to the family. The late Kabiyesi Oba Jimoh Oladunni Oyewumi Ajagungbade III alienated their interest there completely, awarding the land to the NBC as owners of the land of the NBTS and BUTH.”

Barrister Bankole of Smith and Bankole Chambers Victoria Island Lagos, said however the family made a resurgence claiming the land originally belonged to them, informing the new development made Oba Olaoye to wade in.
“But years after, the family came up and said that the land originally belonged to them. Our original contention was that we don’t know them, even in the 100 years lease-hold, their name was not mentioned there, it was the reigning Soun then and the chiefs and people of Ogbomoso that leased it to us. How come that after 100 years and after we had even built gigantic structures that you now show your face, but our position was that their case was not supportable in law.
“But at the coming of the current Kabiyesi Oba Ghandi Afolabi Olaoye Orumogege III he intervened, and appealed to both parties, and the leadership of the Nigerian Baptist Convention under Rev’d Dr Akanji considered it that we should concede some things to them while the ownership completely resides with us. So, we entered into those terms and the terms were passed as judgement of the court. So, the case was not withdrawn, it was concluded.”
Pressed further he stressed it’s now an outright purchase.
“It is an outright purchase now. In fact there is a clause in it that nobody can claim on their behalf, that they shouldn’t disturb us and if anybody should come up in the future they will be held responsible.”
Speaking on the terms Barrister Bankole highlighted some of the agreements.

According to him, the terms are “A building shall be named after them and they are to choose the name. Also that we should do some corporate social responsibility which involves engaging two of their children who are qualified and who are ready to conform to the employment rules of the institution – competence is especially vital, two members of the family in perpetuity. There is also a clause that persons of 65 years of age among them who have common ailments would receive 50 per cent discount minus laboratories and surgery charges. These are the main features there.
“Also, l think there is a clause in the issue of scholarship in the institution for two of their children in perpetuity. But these are more or less issues of corporate social responsibility,” which he pointed out “falls within what Baptist has been doing ever since the time of the Oyinbos. So, while not include them there?”
