Soun stool: Prince Kabiru Olaoye heads to Supreme Court

Dissatisfied with the judgement delivered Tuesday at the Appeal Court sitting in Ibadan in favour of Soun of Ogbomosoland Oba Ghandi Afolabi Olaoye, Prince Kabiru Muhammed Olaoye, the plaintiff, has entered an appeal.
ogbomosoinsightonline.com recalls that Prince Olaoye in suit no. HOG/27/2022 challenged the nomination and selection of the then Prince Ghandi Afolabi Olaoye as Soun-elect citing various breaches in the provisions of the Soun Chieftaincy Declaration among others.

But during the process of litigation the nomination of Prince Ghandi Olaoye was approved by the Oyo state governor Engr Seyi Makinde leading to his installation by the kingmakers in September 2023.
Events however took a dramatic turn in October 2023 as an High Court in Ogbomoso sacked Oba Ghandi.

An injunction restraining the enforcement of the judgement was swiftly obtained sequel to which an appeal was filed at the Appeal Court by the Oba and the Oyo state government seeking his restoration.
Subsequently, his coronation was held in December 2023, and he has since been reigning.

Meanwhile, the judgement on Tuesday affirming him as the Soun at the Court of Appeal ogbomosoinsightonlinemcom learned authoritatively has been challenged.
“The lawyers of Prince Kabiru Olaoye as of yesterday had entered an appeal against the judgement,” a veritable source told Ogbomoso Insight Wednesday.
It’s further gathered that the notice of appeal was filed immediately after the judgement “according to the instructions of the applicant.”
“It is nothing unexpected, he is exercising his right, seeking justice on what he feels is not right. If it had been the other way round wouldn’t they have gone to the Apex Court?”

It was said however Prince Kabiru Olaoye’s lawyers are waiting to obtain the certified true copy of the judgement in six days’ time for studying and to determine the grounds of appeal. “But l can tell you the matter is already in the Supreme Court, that’s where the final decision will be taken, by then they will get the conditions of appeal. He will wait patiently,” the source informed.
