BREAKING: Court stops Soun-in-Council from removing Chief Imam

An Oyo State High Court sitting in Ogbomoso Thursday restrained the Soun-in-Council from asking the Chief Imam of Ogbomosoland Teliat Yinus Olushina Ayilara from performing his functions.

In a ruling Thursday Justice A. A. Adedokun the presiding judge granted the prayer of the applicant, Teliat Ayilara, seeking an interim injunction restraining the Soun-in-Council from removing him pending the determination of the substantive suit.

Alhaji Teliat Ayilara in Suit no. HOG/2/2023 had on Wednesday filed an motion exparte praying for an order of interim injunction to restrain the Areago of Ogbomosoland High Chief Sobalaje Otolorin (the defendant), “whether by himself, his agents, privies, or any person or group of persons acting on the instruction of the defendant from suspending removing or, in any manner whatsoever tampering with the office of Grand Chief Imam of Ogbomoso land being occupied by the claimant pending the hearing and determination of the motion on notice.”

Also, an order of interim injunction “restraining the defendant/respondent whether by himself. his agents, privies, or any person or group of persons acting on the instruction of the defendant from making any attempt in any manner whatsoever to give effect to his purported letter dated 20″ January, 2023 pending the hearing and determination of the motion on notice” and “for such further orders as this honourable court may grant in the circumstances.”

Justice Adedokun after hearing the pleas “ordered as prayed,” adding, “The defendant/respondent is hereby restrained, by way of interim injunction, either by himself, his agents, privies or any person or group of persons acting on the instruction of the defendant from suspending, removing, or in any manner whatsoever tampering with the office of the Grand Chief Imam of Ogbomoso Land being occupied by the claimant/applicant pending the hearing and determination of the Motion on Notice.

“An order of interim injunction is also made restraining the defendant/respondent either by himself, his agents, privies or any person or group of persons acting on the instruction of the defendant from making any attempt in any manner whatsoever to give effect to his purported letter dated 20 January, 2023 pending the hearing and determination of the Motion on Notice.”

The case meanwhile is adjourned to February 1, 2023.

ogbomosoinsightonline.com recalls that in a letter dated January 20, and signed by acting chairman of the council High Chief Sobalaje Otolorin asked Teliat Ayilara to “step aside” as Chief Imam of Ogbomosoland sequel to controversies over his true identity as sections of the Ayilara family whose slot he used to occupy the position claimed he is not a member of the family and so petitioned the Soun-in-Council seeking that the matter be looked into.

The Soun-in-Council after its various committees on the matter carried out series of investigation asked in a letter dated January 20 that Teliat Ayilara “step aside” while the family resolves the issue.
